Earlier this week the Nevada legislature passed a bill to give more rights to those pulled over for driving while intoxicated in Las Vegas. The Nevada Senate approved unanimously via vote Assembly Bill 67. AB67 updates DUI law regarding blood test. If signed by Governor Sandoval, the bill will require law enforcement to get a warrant when drivers decline to give samples needed by police to prove DUI in Southern Nevada. The bill also changed DUI law so when people who fall asleep in cars without it running, they can not be given a DUI citation. The United States and Nevada Supreme Court had recently issued decisions that necessitated the changes to the law. While the bill passes the Nevada Senate without any no votes, when voted on by the entire Assembly, three members of the Assembly voted against it. Those three votes were from Las Vegas Assemblywoman Dina Neal, Assemblywoman Irene Bustamante Adams, also from Las Vegas and Reno, NV Assemblywoman, Teresa Benitez-Thompson. AB 67 was proffered by the Nevada Attorney General and the Assembly Judiciary Committee. When the bill was heard in the Judiciary Committees of the Assembly and the Senate the office of the Nevada Attorney General [...]

Ms. St. Martin was pulled over when police saw her driving in the incorrect direction on a one way street. The governor, in a statement, expressed his disappointment in Ms. St. Marin and praised Reno police and Nevada Highway Patrol for their part in the arrest. For her part, the communications director for the Sandoval Administration released her own statement apologizing for the infraction and promised to cooperate with any and all investigations. Ms. St. Martin was raised in Ely, NV and had previously worked on campaigns and even Nevada offices of two prominent Republican members of the Nevada congressional delegation, Senator Heller and Representative Heck. Ms. Martin graduated from UNLV and also had worked for a number of Las Vegas public relations and marketing firms. Ms. St. Martin in 2012 ran for Nevada State Senate in Senate District 9. In rare cases, however, it can take months for the injuries that can be attributed to drunk driving in Clark County to come to light. In February, Senator Reid’s brother, Larry Reid, was arrested in connection with a DUI arrest in Boulder City, approximately 25 miles to the east of Las Vegas. In the arrest for driving under the influence of alcohol in Las Vegas, Mr. Larry Reid was cited for a number of additional violations of the law. An increased focus on traffic safety as opposed to simply writing tickets for revenue purposes has had an unintended consequence for the budget of the Nevada court system. As Las Vegas area police agencies have increased ticketing for driving infractions such as driving while intoxicated in Las Vegas in an effort to reduce the number of pedestrian fatalities and automobile accidents that have resulted in death. Finding for the increased focus on Southern Nevada driving infractions has come from grants from the State of Nevada’s Joining Forces grant. The Joining Forces grant has been used to ameliorate budgets from increased overtime for police, the costs associated with consumables used in DUI checkpoints and increased advertising for pedestrian awareness, Clark County DUI and even speeding. Since this increased ticketing for drunk driving in Southern Nevada, speeding and even cell phone use while driving began, the money available to the Nevada court system to operate. Currently, for the budget year 2015, the Nevada State court system is showing a $700,000 deficit. Typically, the Supreme Court of Nevada gets between $30 and $110 for each ticket issued by Las Vegas police. The number of tickets written in Nevada in 2010 were over 615,000. [...]

Last Friday, a Southern Nevada assemblyman was arrested for driving while intoxicated in Carson City. The Assembly representative from District 18 in Las Vegas was picked up by Carson City police at 3am Friday morning in the front seat of his parked car with his hand on the stick shift and his right foot on the gas pedal and the engine on and heater running. Assemblyman Carrillo, a holder of a conceal weapons permit for Nevada, notified police he had a loaded handgun in the glove compartment of his automobile. The Assemblyman from District 18 was booked on driving while intoxicated in Nevada and returned to work on Tuesday morning, March 3rd. Mr. Carrillo posted bail of $3,000 with Carson City traffic court. There are a number of DUI instances where the arrested individual was not driving their automobile, per se, but instead, sleeping in their vehicle. In colder climes, or even the Las Vegas desert, which can fall to low temperatures in the winter months, those individuals have been busted because they have turned on their cars to ensure the heater is on and they don’t freeze. Unfortunately, law enforcement still consider this a Nevada DUI offense as it is [...]

Other Reasons Behind Las Vegas DUI arrests

By | 2015-02-07T23:51:25-07:00 February 7th, 2015|Categories: DUI, Online Legal Services|Tags: , , , , , |

There are awards given out for the greatest number of Las Vegas DUI arrests given out in the Las Vegas area by the Nevada Highway Patrol. Let that sink in for a minute. Officers get awarded for arresting people, no matter how the case turns out, the circumstances, or the true nature of whether the person was actually intoxicated or not. We certainly are not arguing that endangering others and potentially causing serious car injuries or deaths by driving dangerously is a good idea. But good people are arrested for driving under the influence for no good reason. Officers are having bad days, and can interpret legitimate and respectful questions as resistance and back talk, and use that as a reason to scrutinize a road test for driving under the influence in Las Vegas beyond what it should be, and initiate an arrest. Equipment is notorious for not being accurate. There are rules about how much and how often breathalyzers must be inspected and recalibrated, and that is often ignored or forgotten. Blood test results can be and sometimes are misplaced or misnamed, or other things that and remove the viability of the test for driving under the influence. And [...]

It should surprise no one that police are setting up checkpoints and stepping up enforcement around Las Vegas DUI activities for the Super Bowl Weekend. The police usually set up checkpoints in Southern Nevada for DUI enforcement. That recent article has a large number of different police departments planning for stepped up patrolling operations, from Henderson Police to the Las Vegas Metro Police, Nevada Highway Patrol, and others participating in the Joining Forces program. The number of people arrested for driving under the influence in Clark County is way down. Looking at the numbers versus the last two years, the drop is almost shocking. Could Metro be troubled with [...]

Apparently this New Year’s Eve celebration in Las Vegas was relatively low key from a law enforcement perspective. There were still plenty of people having a good time, but fewer people arrested for driving under the influence in Las Vegas, as well as a host of other misdemeanors and felonies. That there were DUI arrests in Southern Nevada on New Year’s Eve is fairly unremarkable, as that happens across every city across the country. While some might find that disappointing, that the number of people arrested and charged with drinking and driving is higher on that night, it’s been that way as long as this was the biggest party night of the year. But this year, compared to other recent years, was mild, according to the Las Vegas Metro Police force. Only an estimated less than one percent of all the partiers in Las Vegas for New Year’s were arrested – 32 arrests out of a projected 340,000 people who came to party on the strip and related areas, including Downtown Las Vegas. That includes nine people who were charged with DUI in Clark County. If you were charged with driving under the influence in the Las Vegas area, either [...]
